Overview

This Disclaimer governs your use of the trip·all·out website and hotel meta-search service, operated by ZapWorld LLC. By accessing or using the Service, you agree to this Disclaimer in full. If you do not accept any part of it, please exit the Service immediately.

trip·all·out is a price comparison and aggregation tool. We display hotel rates and availability sourced from third-party data providers, principally Hotellook and its network of booking platforms. We are not a hotel, an online travel agency, or a direct booking service. We do not accept reservations, process payments, hold deposits, or enter into any contract for accommodation on your behalf.

Everything displayed on the Service - prices, availability, star ratings, amenity lists, photos, and user reviews - originates from third-party data feeds and is presented for informational purposes only. The booking transaction itself takes place on the partner's platform, and you are subject to that partner's terms, conditions, and cancellation policies from the moment you click through.

Price Accuracy and Availability

Hotel rates displayed on trip·all·out are retrieved in real time from third-party data providers. We make no warranty - express, implied, or statutory - that any price shown on the Service is:

• Currently available at the time you attempt to book it on the partner's website;
• Free from errors introduced by the originating supplier's data feed or API;
• Inclusive of all applicable taxes, resort fees, destination charges, local levies, service fees, or other surcharges imposed by the hotel or booking partner;
• The lowest rate available through all booking channels for the same hotel and dates;
• Representative of rates available to all travelers (rates may vary by loyalty status, membership, or geographic origin).

Hotel room prices can change within seconds. Demand fluctuations, inventory closures, currency exchange updates, and delays in data feed synchronization all mean that a price visible on trip·all·out may not match the price you see when you land on a booking partner's checkout page. This gap is sometimes called price disparity, and it is an inherent characteristic of meta-search platforms across the industry - it is not a defect unique to our Service.

We strongly recommend verifying the final price, including all taxes and fees, directly on the booking partner's checkout page before you confirm any reservation. If the price you see on the partner's site differs materially from what was displayed on trip·all·out, you are under no obligation to proceed with the booking.

trip·all·out bears no responsibility for any discrepancy between a price shown on our platform and the price presented at any stage of the booking process on a third-party partner's website.

Affiliate Disclosure

trip·all·out participates in affiliate marketing programs. This is our primary source of revenue and the mechanism by which the free Service is funded. When you click a rate link labeled "View Deal," "Check Rates," "Book Now," or similar, and subsequently make a booking on a partner's website, we may receive a commission payment from that partner.

This commission is paid by the booking partner out of their margin. It is not added to the price you pay and does not cost you anything additional. The same hotel room booked through the partner's website directly, or through trip·all·out, should cost you the same amount (subject to the price accuracy caveats above).

The existence of an affiliate relationship may influence the presentation of results. Where results are ordered by factors other than price (such as partner relevance scores, bid adjustments, or our own assessment of booking reliability), we disclose this where technically feasible. Results marked as "Sponsored" or "Featured" represent inventory for which we receive enhanced compensation from the respective partner.

This disclosure is made in compliance with the Federal Trade Commission's guidelines on endorsements and testimonials (16 CFR Part 255) and equivalent regulations in other jurisdictions, including the UK ASA CAP Code and the EU Directive on consumer rights.

No Booking Guarantee

A search result displayed on trip·all·out does not constitute a reservation, a confirmed booking, or any commitment by a hotel or booking partner to provide accommodation at the displayed rate. No booking is created through trip·all·out. All reservations are made directly with the booking partner and are subject to that partner's booking terms, cancellation and refund policies, and payment processing requirements.

ZapWorld LLC is not a party to any contract between you and a hotel, accommodation provider, or booking platform. We disclaim all responsibility for:

• Reservations that fail to process correctly on the partner's platform due to technical errors, session timeouts, or payment failures;
• Overbookings, hotel closures, renovations, or changes to property conditions that occur after a booking is confirmed;
• Cancellation fees, non-refundable deposits, or penalties imposed by the hotel or booking partner;
• Billing errors, unauthorized charges, or price changes applied after checkout on a partner's website;
• Failure of the hotel to honor a confirmed reservation;
• Travel disruptions, force majeure events, or government restrictions that affect your stay.

For any issue arising from a booking, your point of contact is the booking partner through which the reservation was made, and ultimately the hotel itself. trip·all·out has no ability to modify, cancel, or compensate for bookings made through third-party platforms.

The Service contains links to third-party websites and booking platforms. These links are provided for commercial and informational purposes as part of the meta-search experience. We do not endorse, control, or assume any responsibility for the content, privacy practices, accuracy, or terms of service of any website you visit after leaving trip·all·out. You access all third-party sites at your own risk.

Hotel descriptions, property photos, amenity information, star ratings, and user reviews displayed on trip·all·out are sourced from third-party data feeds. We do not independently verify this content and cannot guarantee its accuracy, completeness, or timeliness. Photos may not accurately represent the current condition of a property. Star ratings may use different classification systems across different booking partners and countries.

Limitation of Liability

To the maximum extent permitted by applicable law, ZapWorld LLC, its officers, directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

• Any loss of savings expected from a price displayed on the Service that was not honored by a booking partner;
• Travel disruptions, missed connections, accommodation issues, or consequential losses caused by booking errors on partner platforms;
• Data loss, system failures, or unauthorized access to your accounts on third-party websites;
• Any financial or other loss arising from your reliance on information - including prices, availability, property descriptions, or ratings - provided through the Service.

Our total liability to you for any claim arising out of or in connection with your use of the Service shall not exceed the greater of: (a) the commission, if any, received by ZapWorld LLC in connection with a booking you made through the Service, or (b) fifty United States dollars (USD $50).

Some jurisdictions do not permit the exclusion or limitation of implied warranties or certain damages. If you are located in such a jurisdiction, some of the above limitations may not apply to you. In those cases, our liability is limited to the fullest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless ZapWorld LLC and its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including, but not limited to, reasonable attorneys' fees) arising from:

• Your use of the Service in a manner that violates this Disclaimer or any applicable law or regulation;
• Your violation of any third-party right, including any intellectual property, privacy, or contractual right;
• Any booking you make through a third-party partner linked from the Service;
• Any content or data you transmit through or in connection with the Service.

This indemnification obligation will survive the termination of your use of the Service and any changes to this Disclaimer.

Governing Law

This Disclaimer and any dispute arising under it shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. You consent to the exclusive jurisdiction and venue of the courts located in Delaware for any legal action arising out of or relating to this Disclaimer or your use of the Service.

If any provision of this Disclaimer is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
